This website is operated by Kerto Elvin (trading as Kerto Art). Throughout this site, the terms “we”, “us” and “our” refer to Kerto Art. Kerto Art offers this website, including all information, tools and services available on this site, to you, the user, conditional upon your acceptance of all the terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including any additional terms, conditions and policies referenced here. These Terms of Service apply to all users of the site, including without limitation browsers, vendors, customers, merchants and contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, you may not access the website or use any of our services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check this page periodically for changes. This website and these Terms are governed by the laws of England and Wales. As the United Kingdom is no longer a member of the European Union, references in these Terms to applicable law mean the law of the United Kingdom (and, where relevant, retained EU law as it forms part of UK law), not the law of the European Union.

1. Online Store Terms

By agreeing to these Terms of Service, you confirm that you are at least 18 years old, or that you have your parent’s or guardian’s consent to use this site if you are under 18.

You may not use our products for any illegal or unauthorised purpose, and you must not, in using the Service, violate any laws applicable to you (including but not limited to intellectual property and consumer protection laws).

You must not transmit any worms, viruses or any code of a malicious or destructive nature.

A breach or violation of any of these Terms will result in immediate termination of your access to our Services.

2. General Conditions

We reserve the right to refuse service to anyone, for any reason, at any time, subject to your statutory rights as a consumer.

You understand that your content (excluding payment card information) may be transferred unencrypted and may involve (a) transmission over various networks, and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Payment card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the Service, or access to the Service, without our express written permission.

The headings used in this agreement are included for convenience only and do not limit or otherwise affect these Terms.

3. Accuracy, Completeness and Timeliness of Information

We are not responsible if information made available on this site is inaccurate, incomplete or out of date. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate, complete or timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain historical information, which is not current and is provided for reference only. We reserve the right to modify the contents of this site at any time, but we are under no obligation to update any information on our site. It is your responsibility to monitor changes to our site.

4. Modifications to the Service and Prices

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content of it) without notice.

We will not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service, except as required by the Consumer Rights Act 2015 in relation to orders you have already placed.

5. Products or Services

Some of our products are made or framed to order, including our framed artwork; others (for example, greeting cards, notebooks, cushions, placemats and coasters) are sold ready-made from stock. Made-to-order and ready-made products may have limited quantities and are subject to return or exchange only in accordance with our Returns Policy and your statutory rights.

We make every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your device’s display of any colour will be accurate.

We reserve the right, but are not obliged, to limit the sale of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services we offer. All descriptions of products and pricing are subject to change at any time, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for a product or service made on this site is void where prohibited by law.

This does not affect your statutory right, under the Consumer Rights Act 2015, to receive goods that are as described, of satisfactory quality and fit for purpose.

6. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, at our discretion, limit or cancel quantities purchased per person, household or order. These restrictions may apply to orders placed using the same customer account, the same payment card, and/or the same billing or shipping address. If we change or cancel an order, we may attempt to notify you using the e-mail address and/or billing details provided when the order was placed. We reserve the right to limit or prohibit orders that, in our judgement, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made through our store, and to promptly update your account details, including your email address and payment card details, so that we can complete your transactions and contact you as needed.

7. Personal Information and Privacy

Your personal information is processed in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003 (as amended). Details of what we collect, how we use it, how long we keep it, and your rights (including the right to access, correct, delete or object to the use of your data, and to complain to the Information Commissioner’s Office) are set out in our Privacy Policy.

8. Errors, Inaccuracies and Omissions

Occasionally, information on our site or in the Service may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change, update or cancel orders if any information is inaccurate, at any time and without prior notice (including after you have submitted an order).

We are under no obligation to update, amend or clarify information in the Service or on any related website, including pricing information, except as required by law. No specified update or refresh date on the Service or any related website should be taken to indicate that all information has been modified or updated.

9. Prohibited Uses

In addition to the other prohibitions set out in these Terms, you are prohibited from using the site or its content:

  2. to solicit others to perform or participate in any unlawful acts
  3. to violate any UK statute, regulation, rule or local law, including the Digital Markets, Competition and Consumers Act 2024 and the Consumer Rights Act 2015
  4. to infringe our intellectual property rights or those of others
  5. to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability
  6. to submit false or misleading information
  7. to upload or transmit viruses or other malicious code that will or may affect the functionality of the Service, any related website, other websites, or the internet
  8. to collect or track the personal information of others
  9. to spam, phish, pharm, pretext, spider, crawl or scrape
  10. for any obscene or immoral purpose
  11. to interfere with or circumvent the security features of the Service or any related website, other websites, or the internet.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

10. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that results obtained from use of the Service will be accurate or reliable.

We may remove the Service for indefinite periods, or cancel it at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your own risk. The Service and all products and services delivered to you through it are (except as expressly stated by us, or as required by law) provided “as is” and “as available”, without warranties or conditions of any kind, either express or implied, including implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement, except where such warranties cannot lawfully be excluded.

To the fullest extent permitted by law, Kerto Art, its officers, employees, affiliates, agents, contractors, interns, suppliers, service providers and licensors will not be liable for any indirect, incidental, punitive, special or consequential damages arising from your use of the Service or any products procured through it, including but not limited to lost profits, lost revenue, lost savings or loss of data.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the laws of England and Wales, including your statutory rights under the Consumer Rights Act 2015.

11. Indemnification

You agree to indemnify, defend and hold harmless Kerto Art, our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from and against any claim or demand, including reasonable legal fees, made by any third party as a result of, or arising from, your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

12. Severability

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will nonetheless be enforced to the fullest extent permitted by applicable law, and the unenforceable part will be severed from these Terms. Such a determination will not affect the validity and enforceability of the remaining provisions.

13. Termination

Obligations and liabilities incurred by either party before the date of termination will survive termination of this agreement for all purposes.

These Terms of Service remain effective until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our site.

If, in our judgement, you fail to comply with any term of these Terms of Service, we may also terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services (or any part of them).

14. Entire Agreement

Our failure to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of that right or provision.

These Terms of Service, together with any policies or operating rules posted by us on this site, constitute the entire agreement and understanding between you and us, and govern your use of the Service. They supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us, including any prior versions of these Terms of Service.

Any ambiguity in the interpretation of these Terms of Service will not be construed against the party that drafted it.

15. Governing Law and Jurisdiction

These Terms of Service, and any separate agreement under which we provide you with Services, are governed by and construed in accordance with the laws of England and Wales. The United Kingdom left the European Union on 31 January 2020, and these Terms are governed solely by the domestic law of the United Kingdom, not by European Union law.

The courts of England and Wales have exclusive jurisdiction to settle any dispute arising from, or in connection with, these Terms, except that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates to our website. It is your responsibility to check our website periodically for changes. Your continued use of, or access to, our website or the Service after any changes are posted constitutes acceptance of those changes.

17. Shipping

UK customers.  Please allow 2–6 weeks for framed artwork (depending on finish and availability of frames). We ship via Signed For couriers or Royal Mail 1st Class, depending on order value and volume. Deliveries are usually made Monday to Friday, 8am–8pm. A signature is usually required on delivery; please let us know if you would like your order delivered to an alternative address.

International customers. Please allow up to 6 weeks for delivery. All international orders are sent via Signed For couriers or Royal Mail.
